Please read the below statements before commissioning me.
The following Terms of Service are relevant to NON-COMMERCIAL projects only and are subject to revisions, editing, and additions without notice. Prices and policies are partly based on the book, "Graphic Artists Guild Handbook: Pricing & Ethical Guidelines, 13th Edition".
1.) Displayed base prices are subject to change according to the complexity, difficulty, size, and medium of each individual piece.
2.) Clear and concise visual references and/or descriptions of a commission idea must be provided by the Client. After which a preliminary quote will be provided by the Artist. An invoice will be sent to the Client’s preferred email after reaching an agreement regarding the desired details and price.
3.) Payments under $100 must be made in full within 72 hours of the invoice being sent to the Client’s provided email before any work will be started. Payment plans are available for orders costing greater than $100. Once payment has cleared, the Client's commission will be added to the Artist's publically viewable work queue, hosted on Trello.
4.) Payments are accepted in USD only. Paypal is the preferred method of payment. The Cash App developed by Square is an available alternative payment method. The Artist will not accept payment in any other form. The exception to this is cash sales performed in person during conventions.
5.) The Client will have the opportunity to direct alterations of the work during the sketch/thumbnail stage, and again at the flat color stage. Requested revisions that diverge from the Client's original commission description/references may increase the length of time a commission takes and will be billed separately. Minor revisions can be made after the commission is complete.
6.) Critiques and redline corrections for commissions above $100 are welcomed to ensure the best result. Commissions under $100 are considered small works, thus revised sketches are not factored into the price.
7.) The Artist reserves the right to reject critique and redline corrections pertaining to artistic skill or style preference (i.e. anatomy, coloring style, etc.) or if said critique reduces the artistic quality of the piece.
8.) The refund policy is as follows: If the Client wishes to cancel their commission before work begins, the Artist will retain 5% of the original commission payment in US dollars as a convenience fee. In the event of Client cancellation during the sketch/thumbnail stage phase, a 50% refund of the original payment will be issued. No refund will be issued if the Client cancels during the color stage, or after the commission is complete. If the Artist cancels the commission, 100% of the original commission payment in US dollars will be refunded to the Client.
9.) The Artist reserves the right to cancel a commission and issue a refund due to poor communication, rude or inappropriate behavior, an inability to communicate in clear/effective English, or an unforeseen inability to complete the commission.
10.) Communications about commissions between the Client and Artist will take place solely through [email protected] OR [email protected] for the purpose of record-keeping and consolidation. The Artist will not discuss commissions with a Client using a personal note on sites, instant messenger, or public forum.
11.) The Artist ensures the Client will receive email updates on the commission when necessary. Clients are encouraged to check-in when they feel it's necessary for updates, assurance, reminders, or questions. Public updates will also be made via Twitter.com (@ALBIN0KITSUNE), Deviantart.com (Albino-Kitsune), and FurAffinity.net (Albino-Kitsune), and Weasyl.com (Albino-Kitsune).
12.) The Artist will not handle the depiction of illegal activities, sexually explicit (x-rated) materials, hateful images, or trademarked characters without permission from the trademark holder. Non-explicit fetish, artistic nudity, violence, gore, drug use, and humorously offensive work will be considered on a case-by-case basis. The Artist reserves the right to reject any commission for any reason.
13.) The Artist retains the right to display all commissioned work on any personal website, gallery, or journal. If the commissioned work is a time-sensitive gift the Artist may delay public showcase at the request of the Client.
14.) The Artist retains ALL the rights to the commissioned artwork, including the right to make prints and merchandise and to alter the commissioned work to make it more generic for print at the Artist’s discretion. Image rights can be negotiated for an added fee.
15.) The Client retains all rights to their respective characters. This does not allow them the rights to the commissioned image. (see articles 13 and 14)
16.) The Client may not profit from the artwork beyond the resale of a physical original painting or drawing (traditional media, not digital). This includes the sale of the digital files or rights to the image.
17.) The Client may create up to three prints for personal use (display in their home or as gifts). The Client may also resize or crop the artwork to create icons, wallpapers, or other graphics to be used in non-commercial digital format, but the Client cannot alter the artwork itself, nor is the Client permitted to seek alterations performed by a third party without explicit permission from the Artist. The Client may upload the artwork to their personal website or gallery, but it must be accompanied by a credit line to the Artist, and it must not be any high resolution or an unwatermarked version of the artwork.
18.) The Artist may recycle sketches and preparatory works that were rejected by the Commissioner for other commissions or personal works.
19.) In the event that a client is unreachable by ordinary contact means (email) for 3 months or more, the Artist reserves the right to cancel the commission and retain a 5% fee. If the Client is unreachable for 6 months or more, a refund will not be issued. The Client is welcome to receive a credit valid toward another commission at the Artist’s current rate (having rescinded their spot in line due to lack of communication). If the Client is unreachable for 1 year or more, then the payment is void.
20.) The Artist is not responsible for lost or damaged items sent by mail.
21.) The Client must read, understand and agree to all the above terms before entering into an agreement with the Artist. By sending payment, the Client agrees to the above terms.

With the intent to both summarize and expand upon the preceding formal Terms of Service, I have organized important details of interest into the following sections listed. Further information pertaining to my refund policies, rules/requests for clients interested in reposting their commissioned work, postage costs, hourly rates, and acceptable subject matter with regards to NSFW commission inquiries can be found below.

- I reserve all rights granted unto me by US Copyright law. My work may not be capitalized by the client nor utilized outside of fair use.
- I retain the right to post the finished piece for self-promotion. However, a request can be made to not post the piece for privacy reasons. This request nulls the commissioner’s privilege to repost the piece.
- I will issue takedown notices of edited versions of the art should the client violate the stated terms regarding redistribution or resale, or if my rights to an image have been violated.
• AS THE CLIENT
- The client retains all rights to their character(s).
- The client may use the art freely as a reference for other artists.
- The client may not pay for, trade services or barter with another artist to edit my art in any manner. I do not allow anyone else to edit my work without my permission. Exceptions to this rule exist in the case of commissioned art being used within icons and banners for use on forums and profiles.
- Only the client has the right to repost the image and cannot give others permission to do so.

• COMMUNICATION
- Email is the preferred form of correspondence for the purpose of record-keeping and consolidation. Twitter, Telegram, or Discord are acceptable methods of contact for notifying me of recent responses that require my attention.
- If the Client chooses to discuss the details of a commission outside of email, the Artist is not responsible for any information pertaining to the illustration’s desired outcome that was missed.
- Updates are available on my Trello board. If you are curious about your commission's progress please check there prior to reaching out via email.
- Make sure all the information that you give me is clear and correct. The client is fiscally responsible for any misinformation I am given that results in mistakes in the commission.
• PAYMENT
- PayPal is my preferred payment method. Square Cash is an available alternative choice.
- Invoices will be sent to the client via the email address provided.
- Displayed base prices are subject to change according to the complexity, difficulty, size, and medium of each individual piece.
- The client is required to pay the invoice sent to them before their commission will be added to my queue on Trello. For commissions over $100, payment plans are available upon request.
- If you'd like to claim a slot, but cannot fill out a form or pay fully for your order at the moment, you may send a minimum partial payment of $10 to hold the slot. This is non-refundable.
- Clients who fail to pay for their commission within 72 hours of being invoiced will have their commission canceled and their slot forfeited. If the slot is still available by the time the client becomes responsive the slot will only be claimed after payment.
• REFUNDS
- If the Client wishes to cancel their commission before work begins, the Artist will retain 5% of the original commission payment in US dollars as a convenience fee.
- In the event of Client cancellation during the sketch/thumbnail stage phase, a 50% refund of the original payment will be issued.
- No refund will be issued if the Client cancels after the linework is finished, during the color stage, or after the commission is complete.
- If the Artist cancels the commission, 100% of the original commission payment in US dollars will be refunded to the Client.
- The Artist reserves the right to cancel and fully refund at any time, for any given reason.
• HOURLY RATES & WORK HOURS
- My work hours are typically 11:00 AM to 7:00 PM. (Central/UTC-06:00)
- Please provide up to 48 hours for responses to emails.
- For clients seeking work that I do not have a base price listed for (comic pages, large paintings, etc.) my hourly rate is $15 ~ $20 per hour, depending on the level of difficulty and detail.
- Invoices for hourly billing have the option of being sent after a set amount of time, daily, or weekly.
• TURN-AROUND TIME ESTIMATIONS & DEADLINES
- Time estimates are available upon request. Please remember that these are estimates and the accompanying prices are subject to change.
- Deadlines can be requested but require my approval and may be subject to rush fees.
- The order in which I complete my queue is up to my discretion, but I venture to work through my queue in the order in which payment is received.
- Depending on the complexity, placement within my queue, and my present state of health, energy, and inspiration, an average commission may take 6-18 weeks to complete.
• EDITS & REVISIONS
- Minor edits are free during the rough sketch phase.
- The rough sketch phase typically lasts no longer than the first hour or two, depending on size and complexity.
- Time is tracked within a comment on the client’s Trello card via a browser extension.
- Revisions requested later in the process can incur a fee depending on the time needed and the complexity of changes being made unless the client has paid for unlimited edits.
• ADDITIONAL FEES
- Revisions requested after the rough sketch phase will be billed separately at an hourly rate.
- Deadlines that are 30 days or less than the date of inquiry will incur an added fee equal to no more than 50% of the base cost, which will be determined from the complexity, difficulty, size, and medium of the requested illustration.
- For extensive details like wings, spots or rosettes, stripes, or ornate markings or tattoos, I will charge an additional 5% of the base cost for every set of details.
- For details and topics that I find exceptionally challenging, there will be an added fee for the time needed to execute such properly. This fee will be considered on a case-by-case basis.
• POSTAGE & SHIPPING
- I will ship orders to anywhere in the world on request.
- Shipping and packaging costs are to be covered by the client.
- Any insurance, delivery confirmation, or tracking desired by the client must be requested and paid for.
- I will not express ship packages unless the client themselves pays the higher shipping rate.
Please note your deadline when ordering your commission to receive it on time. - The artwork is shipped in bubble mailers and placed between cardboard inserts for added protection.
- If the client declines to have their originals shipped to them altogether, then I reserve the right to sell the original, rather than holding onto it indefinitely.
- Digital art pieces will not be shipped unless the client requests printing services for an added fee.
• REPOSTING
- When reposting my art always be sure to credit and link back to my profiles and/or my website.
- It is greatly appreciated that you direct any favorites to the original piece if I've posted it.
- If your character is not in the image, reposting my work will be considered art theft. Takedown notices will be filed.
• SUBJECT MATTER
- Any client that is trying to purchase art of character(s) that do not belong to them will require explicit written permission from the owner of that character.
- I will not draw any kind of art that I consider to be inflammatory. This includes but is not limited to depictions of abuse, especially child abuse, hateful ideology or speech, racism, homophobia and/or transphobia, and anything else with malicious intent or purpose.
